REGARDING THESE TERMS AND CONDITIONS OF SALE
The following terms and conditions of sale (the "Conditions of Sale") will be applicable to all purchases made through the cmvshop.com website (the "Website"). The Website and the goods supplied through it are provided by CMV Meccanica Srl, a company duly incorporated in Italy, with VAT number 04141360166 and subscribed share capital of Euro 10,000.00, registered in the Bergamo Company Register with number, no. 04141360166, of the REA of Bergamo n.438693, and with registered office in Via Canale, 60, 24029, Vertova (BG), Italy, telephone number +39 035713915 (hereinafter referred to as "We", "Ci" and "Our / a / i / e "). When we use "the User" and "Yours" we refer to you, the user of the Site and buyer of the goods.
Buying items through our Website implies knowledge and acceptance of our Terms and Conditions of Use, Shipping Information, Return Policy and Right of Withdrawal, Warranty and Privacy Policy (collectively "Additional Policies"). By accepting these Terms of Sale, you also accept the Additional Policies, which collectively form a legally binding part of the contract between us and the user. The User is invited to carefully read these Conditions of Sale and the additional Policies before proceeding with the purchase of any item from the Website.
CMV Meccanica Srl reserves the right to modify the Conditions of Sale and the additional Policies at any time. Any modification of the Conditions of Sale or the Additional Policies will be valid for all new orders placed after the modification has been posted on the Website. The User is invited to consult the Conditions of Sale and the additional Policies published on the Website before each order, in order to evaluate and accept the changes that have taken place since his last access. It should be noted, however, that we receive all tracking information from our shipping service provider, and this is an estimated delivery time only. Actual delivery dates may vary. Further delivery details will be available on the tracking website of our shipping service provider. Please see PART B below for more information on delivery;
f) we reserve the right to adjust prices, items and special offers at our discretion on this Website, in accordance with all applicable laws and regulations. These changes will not affect orders already placed, even prior to our acceptance.
We will do our best to carry out antivirus checks on the Website but we do not guarantee that the same is free from viruses or other content harmful to the personal computer, tablet, smartphone or other device used by the User. For his part, the User must ensure that he has adequate software and systems installed for checking for viruses and other harmful content on the internet. This does not affect the conditions set out in the Terms and Conditions of Use.
2) AVAILABILITY

4) PLACING AN ORDER

Registration is not mandatory; however, we promote registration in order to facilitate the purchase process during future orders on the Website. The User will always have the possibility to complete his orders as a "guest" without any registration on the Website. b) To verify that the User's data are correct and to manage the payment on our behalf, CMV Meccanica Srl uses an external third party service provider to process the payment. Your personal data, including credit card information, will be transferred and held by that third party payment processor or by those other parties that we may use to carry out anti-fraud checks. We do not hold credit or debit card information. By placing the order, the User expressly consents to the transfer of his data for this purpose. These data will be processed in accordance with the terms of the Privacy Policy without prejudice to all other legal provisions applicable in your country of residence.
c) If we find any inaccuracy during data verification or a discrepancy in credit or debit card information, the purchase process may be delayed, suspended or interrupted.
d) After placing an order through the dedicated section of our Website, the User will be able to access a confirmation page, which summarizes his order, and will receive an e-mail confirming the order (collectively the "Confirmations of 'Order"). The User must carefully double check all the data and information indicated in the Order Confirmations, verifying that they correspond to his intentions.

5) CMV CUSTOMIZED PRODUCTS
a) CMV customized products are intended for personal use only, and must not be used for commercial purposes. CMV reserves the right to refuse any order containing words or symbols that CMV deems to be, in its own discretion, inappropriate, in violation of the rights of third parties or detractors of the CMV brand in any way. By ordering a customized CMV product, the consumer agrees to assume full responsibility and hold CMV harmless against any possible request made by third parties regarding the violation of rights or other damages of any nature that may be suffered by third parties in relation to any part of the personalization created by the customer.
b) CMV customized products cannot be returned, nor is the right of withdrawal applicable, as they are customized items specifically for the customer.
6) ACCEPTANCE OF THE ORDER
a) All orders summarized in the Order Confirmations are subject to acceptance by CMV Meccanica Srl which reserves the right to accept the order for all or only part of the items indicated in the Order Confirmations.
b) The acceptance of the order will be communicated to the User by sending an e-mail with the confirmation of the contract and the subsequent shipment of the items purchased (the "Shipping Confirmation"). The contract between the User and CMV Meccanica Srl will therefore be considered in force starting from the date of the Shipping Confirmation e-mail and will refer exclusively to the items listed therein.
c) While we hope to be able to supply all goods ordered, we reserve the right, at our discretion and without needing to provide any justification, not to accept any offers at any time before the relevant goods have been dispatched. In case of refusal of the order, this will be communicated to the User as soon as is reasonably possible.
7) PAYMENT
a) We will debit the payment on the User's credit or debit card when the User receives the Shipping Confirmation via e-mail, which will specify which items of the order have been shipped and the cost of shipping them (the "E-mail"). If the order is divided into several shipments, we will only charge the User for the cost of the items actually shipped at that time. The e-mail will only include information relating to the items actually shipped at that time, a summary of these terms and conditions, information on the goods purchased, the right of withdrawal, the payment methods and applicable taxes, and any other information that we are required to provide by law. We will contact the User in case of problems in collecting the payment through the card details that he provided during the order process. If the payment is not successful or should not be made, CMV Meccanica Srl is exempted from the delivery of the item / s, without prejudice to any other remedy and right.
b) All prices indicated on the Website include VAT and other applicable taxes.
c) Except as otherwise established in these Conditions of Sale, the price to be paid for the goods is the price indicated in the relevant Order Confirmations at the time of the order.
8) PRICE ERRORS
a) While we try to ensure that all prices shown on the Website are accurate, errors can occur. If, prior to our acceptance of the order as indicated by the Shipping Confirmation, we detect an error in the price of the goods ordered, we will inform the User as soon as reasonably possible, unless otherwise established in accordance with the applicable consumer protection law. The User will then have the option to reconfirm his order at the correct price or to cancel it.
b) If we are unable to contact the User through the contact details provided during the order process, we will consider the order canceled and we will notify you by e-mail.
c) This does not affect all rights and provisions applicable to the User in his capacity as a consumer, in accordance with any applicable consumer protection law.
9) DELIVERY
a) Order Confirmations will include general information about the order as well as an estimated delivery date of the goods. The E-mail will include this estimated delivery date as well as a tracking number that you can use to track your order on our delivery service provider's website and confirm the time of delivery of the item.
b) Delivery will be made to the shipping address in the territory covered by this Website as specified by the User during the order process.
c) For Orders, we estimate a delivery time of approximately 10 working days from the date of dispatch of the Shipping Confirmation (hereinafter, "Shipping Day"). This term is extended to 30 working days in the case of personalized items. All shipments are covered by insurance against loss, theft or damage in transit. We do not ship to post office boxes.
d) Have you purchased a customized CMV item? Personalized items are handcrafted to measure in Italy and therefore require longer processing times. Custom orders are usually delivered within 30 business days from the day of shipment.
e) In the Shipping Confirmation, we will confirm the courier details and the tracking number as soon as the order is shipped. The User can track the status of the shipment of his order at any time

g) Once the goods have been delivered to the User and the same has acquired material possession, the User becomes the owner of such goods and from that moment on any risk of loss, theft or damage will be at his expense. , in compliance with all applicable laws and regulations. Upon delivery, the User must check the condition of the order and whether he has received the exact number of items. Missing items will be reordered and damaged / incorrect items will be returned and, based on these Terms of Sale, replaced and delivered free of charge. The User must notify us of the presence of any damaged, missing and / or incorrect product in accordance with the Warranty pursuant to Part D of these Conditions of Sale.
10) PART C - CANCELLATION OF THE ORDER AND RETURN OF THE GOODS
Right of withdrawal. We provide for the right to withdraw from the contract for any reason within a return period of 14 days from the date of delivery, allowing the User to cancel his contract within 14 days from the physical acquisition of possession of the item (s). The right of withdrawal can be exercised in relation to one or more items delivered, except for personalized items.
In case of withdrawal and return of the items, the User is required to take reasonable care of the items and to return all unwanted products to us at his expense. The User is invited to read our Returns Policy for more information on the return period of 14 days and on the return of goods guaranteed by the Italian Law LD 206/2005, by the European Directive on consumer protection (Directive 2011/83 / EC ) and all consumer protection laws applicable in your country. Please refer to the "Return Policy" for the specific terms and conditions applicable to your withdrawal and refund rights. Defective goods. If you believe that the delivered goods do not materially conform to their description previously provided in the Order Confirmations, are incomplete or damaged or are faulty and we cannot remedy the problem or defect to your reasonable satisfaction, then such goods may be returned without prejudice to the other rights that are guaranteed by the applicable law. The User is invited to carefully read our Returns and Warranty Policies for further information on the return of defective goods or those purchased items that do not correspond to what is described in the Order Confirmations and confirmed in the Shipping Confirmation.
PART D - GENERAL CONDITIONS OF OUR RELATIONSHIP WITH THE USER
11) FINAL USE ONLY
The goods sold on this Website are intended for the private end use of consumers only and are not intended for resale or commercial distribution. The User declares to purchase the products as a consumer.
12) WARRANTY
Each product sold by CMV Meccanica Srl to a purchaser is assisted by the legal guarantee on consumer goods, which covers conformity defects that occur within 24 months from the date of delivery of the goods, provided for by the Community Directive 1999/44 / EC, called also "guarantee of conformity". The warranty does not apply to:
- Improper use of the product, lack of care and damage resulting from an accident during use; the guarantee does not apply in any case of anomalous or non-conforming use of the product itself, which is deviated from the intended purpose and which is proper to it.
- Products that have been altered or modified.
- Normal wear of the product and its components.
- Damage caused by unauthorized repairs or maintenance.
- Cosmetic problems such as discoloration or scratches caused by the use of the product, or any other cause not deriving from defects in material or workmanship.
- Poor conditions of storage, maintenance or use of the product which caused defects such as corrosion or discoloration.
13) FORCE MAJEURE EVENTS
Right of withdrawal. We provide for the right to withdraw from the contract for any reason within a return period of 14 days from the date of delivery, allowing the User to cancel his contract within 14 days from the physical acquisition of possession of the item (s). The right of withdrawal can be exercised in relation to one or more items delivered, except for personalized items. The product must be returned in perfect condition and in its original packaging.
14) WAIVER
Delay in exercising or failure by us to exercise any right or remedy under these Terms of Sale will not constitute a waiver of our rights and remedies under these Terms of Sale.
15) NULLITY
In the event that one or more provisions established in these Conditions of Sale or in the Additional Policies are deemed invalid by the competent authority, the remaining provisions of the Conditions of Sale and the Additional Policies will remain, as far as possible, in force and fully effective between the parties. and the User will always be bound by it.
16) PRIVACY
Personal information, such as the contact details that the User provides during the order process, will be stored and used in accordance with our Privacy Policy.
17) JURISDICTION AND APPLICABLE LAW
This contract is governed by Italian law and interpreted according to the same. Any dispute that should arise regarding the validity, interpretation, execution, or application of this contract, will be devolved to the Italian jurisdiction.
